SH0CK: Lucy Letby escapes further prosecution despite police ‘confidence’ in new evidence

The Investigation of Lucy Letby shows never-before-seen footage of the former neonatal nurse’s arrest.
Netflix has released The Investigation of Lucy Letby, a one-off documentary based on a nurse convicted of murdering babies in her care.
Letby was convicted of killing seven babies and the attempted murder of seven others while she worked at the Countess of Chester Hospital between June 2015 and June 2016.
The former neonatal nurse is currently serving a whole life order which means she will never be considered for release or parole.
Netflix’s documentary features interviews with a close friend of Letby’s, detectives who worked on the case, as well as the mother of one of the babies who died unexpectedly.
In the closing moments of the 90-minute special, it is explained that more “evidence” had come to light last year regarding further deaths.

The caption reads: “In July 2025, the police submitted additional evidence to the Crown Prosecution Service (CPS) affecting nine further babies.
“On January 20, 2026, the CPS announced it would not be charging Lucy Letby with any further offences” after reviewing the further allegations of murder and attempted murder at the Countess of Chester Hospital and Liverpool Women’s Hospital.
However, CPS stated that the “evidential test was not met in any of those cases.”
Cheshire Police was “confident” that it had enough evidence, according to the BBC.

It said in a statement: “We submitted files for charging decisions in relation to nine babies – for consideration of nine offences of attempted murder and two of murder.
“We believed the evidence submitted met the CPS charging standard.
“The CPS did not agree and despite our representations we must respect the decision that has been made.”
The Netflix documentary includes interviews with Canadian honorary consultant neonatologist Dr Shoo Lee who was contacted by criminal defence lawyer Mark McDonald.
One of Dr Lee’s papers had featured in the prosecution case and McDonald was keen to find out if his research had been used correctly during the trial.

Dr Lee agreed to assist and, with a panel of top experts from around the world, wrote a detailed report about the causes of death and collapse in each of the babies’ cases.
He claimed there was no medical evidence that suggested the babies had been murdered.
The Netflix special explains: “In October 2023, the UK Government launched a public inquiry to examine the events at the Countess of Chester Hospital.
“Cheshire Constabulary launched an investigation into corporate manslaughter at the hospital at the same time.
“The Countess of Chester Hospital NHS Trust told the documentary makers it would not be appropriate to comment further due to the ongoing investigation.”
Reach contacted the Countess of Chester Hospital NHS Trust for comment separately.
A spokesperson at the Countess of Chester Hospital NHS Foundation Trust said: “Due to the Thirlwall Inquiry and the ongoing police investigations, it would not be appropriate to comment further at this time.”
